Terms & Conditions

These terms set out the basis on which ruamjaia Law provides family law services. Please read them carefully before engaging us. If you have any questions about what is written here, we are glad to discuss them with you before any work begins.

References to "ruamjaia Law", "we", "us", or "our" mean ruamjaia Law, with registered offices at 27/6 Convent Road, Si Lom, Bang Rak, Bangkok 10500, Thailand. References to "you" or "the client" mean the person or persons who have engaged us to provide services.

1. Scope of these terms

These terms apply to all legal services provided by ruamjaia Law, including pre-marriage agreement drafting, property division mediation, and post-divorce financial reviews. They also apply to any preliminary consultations and to correspondence undertaken on your behalf.

Where a separate letter of engagement or service agreement has been issued and signed, those documents take precedence over these general terms in the event of any conflict. These terms apply to the extent not varied by that agreement.

2. Our services

We provide legal services in the area of family law in Thailand. Our services are described on our website as a general guide only. The precise scope of work for any engagement is confirmed in writing before work begins, and we welcome questions about what is and is not included.

Our services are provided in English. Where a matter involves Thai-language documents, we will explain the relevant contents to you clearly. We do not provide services in languages other than English and Thai without prior arrangement.

Information on our website is provided for general informational purposes and does not constitute legal advice for any individual situation. A proper assessment of your position requires a personal consultation.

3. Fees and payment

Our fees for the services listed on our website are as follows:

Fees are stated inclusive of VAT at the applicable rate unless stated otherwise. Where a matter involves work outside the standard scope described on our website, we will provide a written estimate before proceeding.

Payment is due within 14 days of our invoice unless otherwise agreed in writing. We accept payment by bank transfer to our designated account, details of which appear on each invoice. We do not accept cash payments for invoiced services.

Where work is carried out across multiple sessions, we may request a deposit at the outset. The amount and timing of any deposit will be set out in the letter of engagement.

4. Your responsibilities

To allow us to carry out our work carefully and on time, we ask that you:

We are not responsible for delays or outcomes arising from incomplete or inaccurate information provided to us, or from failure to respond within a reasonable time.

5. Confidentiality

We keep all information you share with us in confidence. We will not disclose information about your matter to any third party without your consent, except where we are required to do so by law or by a court of competent jurisdiction, or where it is necessary to obtain specialist input on your behalf and we have informed you in advance.

Our confidentiality obligations continue after the conclusion of your matter and after any termination of our engagement.

6. Our standard of care

We will carry out our work with reasonable skill and care in accordance with the professional standards applicable to legal practitioners in Thailand. Our advice is based on Thai law as it stands at the time the advice is given, and we are not responsible for any subsequent change in the law.

Nothing in our services constitutes a prediction of the outcome of any court proceeding or negotiation. We offer our professional assessment; the outcome of any matter depends on many factors outside our control.

7. Limitation of liability

Our liability to you in connection with any engagement is limited to direct losses caused by our negligence or breach of these terms. We are not liable for indirect or consequential losses, including lost income, loss of a business opportunity, or any loss not directly arising from our work.

Our total liability to you in respect of any single matter will not exceed the fees paid to us in connection with that matter, except where liability cannot be limited by law.

Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence.

8. Ending the engagement

By you

You may end your engagement with us at any time by notifying us in writing. We will prepare a final invoice for work completed to the date of notice. Any deposit paid will be applied against that invoice, and the balance will be refunded or invoiced as appropriate.

By us

We may conclude our engagement if you ask us to act in a way that we believe would be improper or contrary to our professional obligations, if there is a material breakdown of trust, or if fees remain unpaid beyond 30 days after a payment reminder. In such cases we will give reasonable notice and provide all documents belonging to you.

Upon conclusion of the engagement, we will return original documents and advise you of any upcoming deadlines of which you should be aware.

9. Complaints

We aim to provide a service that is careful, clear, and considerate at all times. If at any point you are unhappy with any aspect of our work, please contact us directly so that we may address your concern. Most concerns can be resolved through a calm conversation.

Formal complaints should be made in writing to [email protected]. We will acknowledge a written complaint within five working days and provide a full response within 20 working days. If you remain dissatisfied, you may refer the matter to the Lawyers Council of Thailand in accordance with their procedures.

10. Data protection

We handle personal information in accordance with the Personal Data Protection Act B.E. 2562 (Thailand PDPA) and our Privacy Policy, which is available on our website. By engaging our services, you consent to our use of your personal data as described in that policy.

11. Website use

The content on our website is provided for general informational purposes only. It is not legal advice, and does not create a solicitor–client relationship. We make reasonable efforts to keep the website accurate and up to date, but we do not warrant that the information is complete, current, or free from error.

You may not copy, reproduce, or distribute content from our website for commercial purposes without our written permission.

12. Governing law

These terms are governed by the laws of Thailand. Any dispute arising from them will be subject to the non-exclusive jurisdiction of the Thai courts.
